These Terms of Service ("Terms") govern your use of the Guber platform, which connects Discovery Bay residents with independent golf cart drivers. By creating an account or using the Service, you agree to these Terms.

1. Eligibility

  • Riders: You must be at least 18 years old to create an account and request rides.
  • Drivers: Drivers must be verified Discovery Bay residents and must hold a valid golf cart permit. Drivers must complete in-app onboarding and identity verification (resident card and cart permit) and receive admin approval before accepting rides.

2. The Service

Guber acts as a technology marketplace that connects riders with independent driver-partners. Guber is not a transportation provider. Drivers are independent contractors, not employees of Guber, and are responsible for their own compliance with Discovery Bay cart regulations.

3. Payments and Fees

  • Fares: Rides are charged at a flat per-passenger rate, with a 2× surcharge applied between 00:00 and 05:59.
  • Platform fee: Guber deducts a 10% platform fee from both the rider's fare and the driver's payout for each completed trip.
  • Driver payout: Drivers receive the remaining portion of the fare, paid out via Stripe Connect.
  • Cancellation fee: A rider who cancels after a driver is en route, or who exceeds cart capacity at pickup, may be charged a fixed wasted-time fee. Driver-initiated cancellations are tracked and may affect driver standing.

All payments are processed securely by Stripe. Cash is not accepted.

4. Liability Waiver

To the fullest extent permitted by law, Guber provides the platform on an "as is" basis and is not a direct transportation provider. Guber does not employ, control, or direct drivers, and is not liable for the acts or omissions of riders or drivers.

Riders and drivers assume all risk associated with the use of the Service. Guber, its officers, employees, and affiliates are not liable for any injury, loss, damage, or expense arising from a ride arranged through the platform.

5. User Conduct

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

  • Abusive, threatening, or harassing messages in in-app chat.
  • Providing false information during onboarding or verification.
  • Repeatedly exceeding cart capacity or misrepresenting passenger counts.
  • Attempting to circumvent payment through the platform.

Guber reserves the right to suspend or ban any user — rider or driver — for low ratings, abusive chat messages, capacity violations, or other conduct that undermines the safety or integrity of the community.

6. Ratings

Both riders and drivers rate each other after each trip. Consistently low ratings may result in removal from the platform.

7. Account Termination

You may delete your account at any time from your profile settings. Guber may suspend or terminate your access if you violate these Terms.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
