Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Guber, and govern your use of the Guber platform, including rides, courier deliveries, the Food Hub, and driver, courier, and cook services. By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service.

1. The Service - Guber as a Neutral Technology Provider

Guber is a software development company providing community technology solutions and digital marketplace infrastructure. The Guber platform is a neutral technology provider: it operates as a digital bulletin board and software matching tool that helps independent community members in Discovery Bay find and arrange services with one another - rides with golf-cart drivers, courier deliveries, and pre-ordered home-cooked meals.

Guber does not employ drivers, own or operate any golf carts, prepare or cook any food, or provide transportation, courier, or catering services of any kind. Guber's role is strictly limited to developing, hosting, and maintaining the software, displaying listings and bookings, and processing payments through the platform. Guber does not direct, control, or supervise how any driver drives, any courier delivers, or any cook prepares food.

Guber Courier is the platform's flagship service. The platform exists first and foremost as a community delivery marketplace: software that helps neighbours in Discovery Bay arrange lawful, everyday local deliveries and errands with one another. Golf-cart rides and Food Hub orders are additional community services offered through the same software. This structure matters: in every service, Guber supplies only the marketplace software - the delivery, ride, or meal itself is always an arrangement between independent community members.

Peer-to-peer cost sharing. Rides arranged through the platform are shared community travel between neighbours, not commercial carriage. Any amount a rider pays is a contribution towards the driver's proportional operating costs of the shared journey - battery or power consumption, maintenance, insurance, and wear-and-tear on the cart - calculated on a flat per-seat basis for convenience. Payments made through the platform are cost-sharing reimbursements of these actual running costs, not fares for the carriage of passengers for hire or reward, and drivers do not offer carriage to the public as a business.

All drivers, couriers, and cooks on the platform are independent community members, not employees, agents, partners, or joint venturers of Guber. Each remains at all times entirely responsible for their own conduct, equipment, permits, insurance, and compliance with all applicable laws and regulations.

2. Eligibility and Accounts

  • You must be at least 18 years old to create an account.
  • Riders must provide accurate account information and a face-verified profile photo.
  • Drivers must hold a valid golf cart permit for the cart they drive. Verification requires the cart permit number and a cart photo, plus the applicant's driver's licence number and the full name on it, all reviewed and approved by Guber before the first ride. Drivers may drive only after admin approval.
  • Food Hub operators must be verified Guber users who operate as legally compliant food providers: licensed caterers, private chefs who cook on-site at the client's home, or sellers of pre-packaged items that fall under permitted or exempt categories. Unverified home kitchens may not sell prepared meals on the platform. Every new operator profile is reviewed by Guber and is listed publicly only once approved.
  • Drivers and cooks must digitally accept the compliance acknowledgment described in Section 3 before providing any services on the platform.
  • You are responsible for keeping your credentials secure and for all activity under your account.

3. User Compliance Acknowledgment

As a condition of using the platform as a driver or cook, you must digitally accept the in-app compliance acknowledgment at onboarding - the driver waiver for drivers, the cook acknowledgment for cooks. By accepting it, and by using the platform, you agree and confirm that:

  • Drivers: you are entirely responsible for complying with all applicable Hong Kong laws and regulations, including Discovery Bay golf-cart permit requirements, traffic rules, passenger limits, and any required insurance, and for the ownership, safe operation, and maintenance of your cart. When acting as a courier, you are likewise solely responsible for the items you agree to carry: you must carry only lawful and permitted items (Section 7), respect your cart's capacity limits, and you may refuse any item. Guber does not verify your legal compliance; the acknowledgment solely records your acceptance of these responsibilities.
  • Food Hub operators: you confirm that you operate as a legally compliant food provider - a licensed caterer, a private chef who cooks on-site at the client's home, or a seller of pre-packaged items that fall under permitted or exempt categories - and that you are entirely responsible for complying with all applicable Hong Kong laws and food safety regulations, including hygiene, safe handling, storage, labelling, and accurate ingredient and allergen disclosure, for every dish you prepare. Unlicensed home-kitchen meal sales to the public are not permitted on the platform. Guber does not cook, prepare, or supervise any food; the acknowledgment solely records your acceptance of these responsibilities.

If you cannot or do not agree to be bound by these responsibilities, you must not use the platform as a driver or cook. Guber may suspend or remove the access of any user it reasonably believes is not compliant with applicable laws, permit requirements, or food safety regulations.

4. GuberHK Credits and Payments

  • Rides and courier deliveries are settled in GuberHK Credits: 1 credit = HK$25 = 1 seat. Credits are a convenient way to prepay and settle peer-to-peer cost-sharing contributions.
  • Cost shares are flat per-seat amounts, shown in full before you confirm a booking and never changed after confirmation. Certain multipliers apply by design: pickup or drop-off at the Golf Club, and rides in the busy windows (15:00-18:00 and 22:00-06:00 Hong Kong time), are each priced at double the base rate.
  • Credits are prepaid in packs in the app and debited for rides, deliveries, and tips. Credit purchases are final and non-refundable, except where a refund is required under these Terms or at our discretion (for example, a cancelled or failed ride).
  • All payments are processed securely by Stripe. Cash is not accepted anywhere on the platform.
  • Platform fee: Guber retains a 20% platform fee from each completed trip and delivery; the driver earns the remaining 80%, paid out via approved payout statements. Tips always go 100% to the driver or courier. For Food Hub orders, the cook earns 80% of the food total and Guber retains 20%.

5. Rides, Capacity, and Conduct During Trips

  • Rides are neighbour-to-neighbour shared journeys (Section 1): the amount you pay reimburses the driver's proportional trip costs, and the driver is a fellow community member sharing the trip, not a carrier for hire.
  • Bookings are made in the app. For each ride you can add passengers, pets (charged as seats), a dedicated luggage or golf-club seat, notes for the driver, and a promo code, or split the cost share between passengers.
  • Cart capacity limits are hard safety limits. Booking fewer passengers than actually show up, such that the cart is over capacity, entitles the driver to cancel and triggers a fixed fee to cover the wasted trip.
  • Riders and drivers communicate through in-app chat. Phone numbers are not shared. Abusive, threatening, or harassing messages are grounds for immediate suspension.
  • Riders must wear available safety restraints where fitted, follow the driver's reasonable instructions, and not compel the driver to breach cart regulations (speed, paths, passenger limits).

6. Scheduling and Cancellations

  • Rides and courier deliveries may be scheduled in advance for a chosen pickup time.
  • A rider may cancel a ride at any time. Cancelling an on-demand ride is free. Cancelling a pre-booked ride within 15 minutes of the scheduled pickup time costs a flat 0.5-credit fee. A pre-booked courier delivery cancelled within 1 hour of pickup costs a 50% cancellation fee.
  • Driver cancellations are tracked automatically and affect driver standing. A cancelled ride is never charged; paid credits are automatically refunded to your balance.

7. Courier Deliveries (Flagship Service)

Guber Courier is the platform's flagship community service: a marketplace where Discovery Bay neighbours arrange local, same-day delivery of everyday items and errands with one another. A sender requests a delivery; an independent community member acting as a courier accepts, collects, and delivers the item. Guber's role is limited to providing the software that displays, matches, tracks, and settles these neighbour-to-neighbour arrangements. Guber is not a courier, carrier, or freight company, does not take possession of any item as a business, and provides no cargo insurance.

Sender responsibilities. You must describe the item accurately, declare its size honestly, provide complete pickup and drop-off contacts, and ensure the item is lawful to send and permissible for a neighbour to carry. Prohibited items include: illegal or restricted goods; dangerous, flammable, or hazardous items; cash, jewellery, or other high-value items; prescription medication; alcohol and tobacco; unpacked fragile items; live animals; and perishables that will not survive the trip. Sending a prohibited item breaches these Terms; the sender remains solely responsible for the item and for any consequences of sending it.

Courier responsibilities. Couriers are independent community members (Section 1). Each courier is solely responsible for complying with all applicable laws, for using only a properly permitted golf cart or lawful walking/scooter means, for respecting cart capacity limits, for carrying only items they judge safe and lawful, and for photographing each item at pickup and drop-off as proof of handover. A courier may refuse any item at their sole discretion.

Risk and liability. Items are carried at the sender's risk within these Terms. To the fullest extent permitted by law, Guber is not liable for any loss, damage, delay, or failure of a delivery arranged through the platform; if a courier fails to complete a delivery, the delivery charge is refunded, and any claim about the item itself is strictly between the sender and that courier.

Standard deliveries cost 1 credit; bulky items (requiring two seats) and late-night deliveries (00:00-05:59) cost 2 credits. Tips are optional and go 100% to the courier.

8. Food Hub

The Food Hub is a marketplace that features legally compliant local food operators - licensed caterers, private chefs who cook on-site at the client's home, and sellers of pre-packaged items that fall under permitted or exempt categories. Unverified home kitchens may not sell prepared meals on the platform. Every operator profile is reviewed by Guber and is listed publicly only once approved.

  • Each dish lists its ingredients, allergens, portion size, order cutoff, and delivery date. Orders must be placed and paid online by card before the cutoff; pay-on-delivery is not available. Delivery is a flat HK$30 per order.
  • Operators are solely responsible for the food they prepare, including hygiene, safe handling, and accurate ingredient and allergen disclosure, and for holding any licence their category requires. Guber does not prepare food and makes no representation about any operator's food other than what the platform displays.
  • Buyers may rate delivered orders (taste, presentation, portion, value). Consistently poor ratings, inaccurate allergen disclosure, or loss of a required licence may result in removal of operator access.
  • If an order cannot be fulfilled (for example, a cook cancels), your payment is refunded in full.

9. Ratings and Community Standing

Riders and drivers rate each other after each trip; buyers rate cooks after each delivered order. These ratings are visible in the app and are used to maintain community standards. Guber may, at its discretion, restrict, suspend, or remove access of any user - rider, driver, courier, or cook - whose ratings, cancellation behaviour, or conduct fall below community standards.

10. Prohibited Conduct

You agree not to:

  • Provide false or misleading information during sign-up, verification, booking, or listing.
  • Misrepresent passenger counts, item sizes, or dish contents.
  • Harass, abuse, or discriminate against other users, in chat or in person.
  • Attempt to circumvent platform payments (including paying drivers, couriers, or cooks outside the platform).
  • Use the platform for any illegal purpose, or to transport prohibited items.
  • Scrape, reverse-engineer, or disrupt the Service, or access another user's data.

11. Intellectual Property

The Guber name, logo, app, and content are owned by Guber or its licensors and are protected by intellectual property laws. You retain ownership of the content you upload (photos, reviews) and grant us a licence to host and display it as needed to operate the Service.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, except those that cannot be excluded by law. Guber does not warrant uninterrupted availability, and does not warrant the conduct, driving, or food preparation of platform users - each driver is responsible for their driving and cart, and each cook for their food.

13. Limitation of Liability

To the fullest extent permitted by law, Guber is not liable for the acts or omissions of drivers, couriers, cooks, or other users, or for any injury, loss, delay, damage, or expense arising from a ride, delivery, or food order arranged through the platform. Guber's total aggregate liability for any claim relating to the Service is limited to the total fees you paid to Guber (platform fees) in the 12 months before the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

14. User Indemnity and Compliance

You agree to indemnify, defend, and hold harmless Guber, its directors, officers, employees, and affiliates from and against any claims, demands, losses, damages, penalties, fines, and expenses (including reasonable legal costs) brought by any person or authority arising out of: (a) your breach of these Terms or your misuse of the Service; (b) your provision of rides, deliveries, or food through the platform, including any failure to comply with applicable Hong Kong laws, vehicle permit requirements, or food safety regulations; or (c) any claim by a passenger, recipient, buyer, or third party arising from a ride, delivery, or meal you performed. This indemnity applies to all users, and in particular to drivers and cooks acting as independent service providers.

15. Termination

You may delete your account at any time from Profile settings. Guber may suspend or terminate your access for violation of these Terms, for conduct that endangers the community, or as required by law. Sections that should survive termination (payment of fees due, limitations of liability, indemnity) survive.

16. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over any dispute arising from them.

17. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above always reflects the current version, and material changes are announced in the app before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
